Starsender Email Marketing

1. Services Provided

Starsender provides email marketing campaign services, including:

• Creation and execution of email marketing campaigns
• Management of email lists provided by clients
• Performance reporting and analytics
• Optional use of Starsender's internal email lists (where available)

2. Client Responsibilities

2.1 Email List Provision

Clients may provide their own email lists for marketing campaigns. By providing an email list, you warrant that:

• You have obtained all necessary consents from recipients
• The list complies with applicable anti-spam laws including CAN-SPAM Act and GDPR
• You have the legal right to use and share the email addresses

2.2 Content Approval

Clients are responsible for approving all campaign content before distribution.

3. Service Plans

Starsender offers multiple service plans with varying features, volumes, and pricing. The specific terms of your selected plan will be detailed in your service agreement.

4. Use of Starsender Email Lists

Starsender will provide clients with performance reports detailing campaign metrics such as open rates, click-through rates, and other relevant analytics. The specific metrics reported will depend on the service plan selected.

6. Payment Terms

Fees for services are as specified in your selected plan. Payment is due as outlined in your service agreement. Late payments may result in service suspension or termination.

7. Intellectual Property

Clients retain ownership of their provided content and email lists. Starsender retains ownership of its platform, technology, and proprietary internal email lists.

8. Confidentiality

Both parties agree to maintain the confidentiality of each other's proprietary information shared during the course of service provision.

9. Limitation of Liability

Starsender's liability is limited to the amount paid for services during the three months preceding any claim. We are not liable for indirect, special, or consequential damages.

10. Termination

Either party may terminate services with written notice according to the terms specified in the service agreement.

11. Governing Law

These Terms are governed by the laws of Bangladesh. Any disputes will be subject to the exclusive jurisdiction of the courts of Bangladesh.

12. Changes to Terms

Starsender reserves the right to modify these Terms at any time. Continued use of services after changes constitutes acceptance of the modified Terms.
